The term ‘Midastouch Jewels’ or ‘us’ or ‘we’ refers to the owner of the website Midastouch

Jewels – Patsy Tyldesley. The term ‘you’ refers to the user or viewer of our website.

The information contained in this website is for general information purposes only. Midastouch Jewels provides the information, and whilst we endeavour to keep the

information up-to-date and correct, we make no representations or warranties of any kind,

express or implied, about the completeness, accuracy, reliability, suitability or availability

with respect to the website or the information, products, services, or related graphics

contained on the website for any purpose. Any reliance you place on such information is

therefore strictly at your own risk.

In no event will we be liable for any loss or damage including without limitation, indirect or

consequential loss or damage, or any loss or damage arising from loss of data or profits

arising out of or in connection with the use of this website.

This website contains material which is owned by or licensed to us. This material includes,

but is not limited to, the design, layout, look, appearance, graphics and photographs.

Reproduction is prohibited other than in accordance with the copyright notice, which forms

of Midastouch Jewels. We have no control over the nature, content and availability of those

Every effort is made to keep the website online and running smoothly. However,

Midastouch Jewels takes no responsibility for and will not be liable for the website being

temporarily unavailable due to technical issues beyond our control.

Price of Goods

The prices of the products you order on this website are to be those prices as displayed at

the moment of processing your order. Where appropriate, all prices will be displayed in

pounds Sterling. This is subject to alteration, when enforced, without notice. Please refer to

individual prices. Postage costs are included in the prices quoted on the website.

Representation and Specification of Goods

Some items may appear slightly larger or smaller than actual size due to screen defaults and

photography techniques. Other items may be represented at a larger than actual size in

order to clearly show details, or smaller than actual size in order to show the entire item.

Due to the limitations of colour display your screen may not show exactly the correct colour

of the product being viewed. Your attention is drawn to the item description where specific

product details are given. This information is given in good faith but total accuracy cannot

be guaranteed.

Website Payment

We accept payments on our website via PayPal and credit/debit cards. If you would like to

pay by bank transfer, please get in touch for details using the details provided on our

contact page. Instalment payments are available through Klarna.

Your order will not be dispatched to you until payment has been confirmed as valid and

lawful and made in full. All prices are quoted in (£) Sterling and include VAT. All quoted

prices include delivery charges. Despatch to some countries may be extra.

Delivery

Some of our items of jewellery take longer to send out than others, as some are made to

order. Please refer to our delivery section which will give you an estimation of how long your

order should take. If your order is urgent and required for a specific date, please contact us

and we will do our best to meet your needs.

Some items are required to be Hallmarked, this adds additional time to the dispatch time.

We shall be under no liability for any delay in delivery or non-delivery due to circumstances

beyond our control. We always insure items over £30.

Please check your goods on delivery. If items arrive damaged/faulty please let us know

within 14 days and arrange to post them back to us. If you do not inform us within 14 days,

then we will have no liability for items said to be damaged/faulty on delivery. Please send

items back via a signed-for postal service for your own proof of delivery. This postage cost

will not be reimbursed unless item is damaged/faulty.

Please be advised that it is the customers responsibility, when ordering from our website or

from our bespoke service, to provide Midastouch Jewels with the correct and complete

delivery address. Failure to do so may result in your order being undelivered or delivered to

the wrong address, for which we will not accept responsibility. Please check that the correct

delivery/shipping address and full name and postcode has been given after processing your

order. If you have provided us with the wrong address, or incomplete address, please let us

know in writing as quickly as possible after placing your order.

Delivery costs for bespoke jewellery are dependent on the order value, and country of

delivery. Please contact us for more information.

Postage and packaging to Europe is charged at a rate of £12.00

International postage and packaging to the rest of the world is charged at a rate of £15.00

Insurance

Midastouch Jewels provides product insurance to items whilst in transit for delivery, and

only up to the point of customer’s receipt of the order. It is the customer’s responsibility for

appropriate insurance cover thereafter.

Stock pieces

The term ‘stock piece’ refers to a piece which is ‘ready-to-wear’, has already been made and

requires no alteration to size, stone or metal. A refund, exchange, or credit note can be

arranged on certain items. This will be made clear at the time of purchase.

Made to order pieces

The term ‘made to order’ refers to a piece which has not been made yet, or has not finished

being made. No refunds or exchanges will be given on any made to order piece unless the

item is damaged or faulty.

Bespoke pieces

No refunds or exchanges will be given on any bespoke piece unless the item is damaged or

faulty.

Gift Vouchers

Midastouch Jewels gift vouchers are available as e-vouchers where a code is emailed to the

customers inbox shortly after the purchase has been made.

If you would like to order a voucher code with a different sum than we currently offer,

please get in touch and we will arrange a voucher code for you.

Our gift vouchers have a 12 month expiry date, from the date of purchase

Our gift vouchers can be used online, over the phone or in person

Our gift voucher codes can only be used once

Gift vouchers can be used on bespoke jewellery, stock items of workshops.

Gift vouchers cannot be exchanged for cash, or used after their expiry date.

Liability & Legal

Midastouch Jewels gives no warranty or representation as to the accuracy, suitability or

reliability of the information or content of the Website for any purpose. Any such

information or content is provided on an ‘as is’ basis without warranty of any kind and,

except where the website is being used by a consumer (within the meaning of the Unfair

Contract Terms Act 1977), all warranties and conditions (including all warranties and

conditions implied by law as to title, satisfactory quality, fitness for purpose and non-

infringement) are expressly excluded in this respect.

We do not accept liability for any typographical, clerical or other errors and/or omissions

and reserve the right to add, delete, and modify any of the information found on the

Website at any time without notice.

We will not accept liability for any direct, indirect, special or consequential loss arising out of

the use of or the inability to use the web site including without limitation, reliance on any

information or service obtained from the website or which results from mistakes, omissions,

interruptions, deletion of files or e-mail, errors, defects, viruses, delays in operation or

transmission, or any failure of performance whether or not limited to Act of God,

communications failure, theft or destruction, save that liability for death or personal injury

arising from the negligence of Midastouch Jewels is not limited or excluded.

Where we have replaced defective products or products failing to meet specification, or

refunded to you the price of such products (or a proportionate part of the price),

Midastouch Jewels shall have no further liability to you.

All pieces sold by Midastouch Jewels Limited shall remain the property of Midastouch Jewels

until payment of the total invoice amount.

You undertake that all details you provide us for the purpose of ordering or purchasing

pieces (including any applicable specification) are correct, that the credit or debit card you

are using for the purpose of ordering or purchasing is your own and that there are

sufficient funds to cover the cost of the product or service being purchased.

If there are any changes to the details supplied to us by you it is your responsibility to

inform Midastouch Jewels within a reasonable period after supply of such details. We shall

have no liability to you arising from your failure to do this.

Warranty Terms and conditions

We offer a full 24 month warranty on workmanship, which commences from the date of

receipt. This warranty is void if goods have been damaged through accident, third party

repairs, misuse, careless handling, normal wear-and-tear, or during transit and delivery by

the postal service or shipping company. We reserve the right to repair or replace faulty

items. If it is determined that the item is not faulty, you will be charged for the return

postage.

Designs & Copyright

The entire content of this website, including products, designs, branding, text, graphics,

design are the sole property of Midastouch Jewels and all rights in such content are

expressly reserved to Midastouch Jewels. Use of the above for any purpose without the

written permission of Midastouch Jewels would be an infringement of UK Patent Law.

Any infringement of design right or copyright (such as copying by other manufacturers or

retailers) would entitle us to take civil action in court with a view to seeking damages.

Copying, republication or modification of this website in whole or part is strictly prohibited.

Ring sizing

We will either take your ring size in person, or if this is not possible, we will send you a

plastic ring sizer, and advise in collaboration with you to decide the correct size according to

your comfort. If the piece is for a surprise, we will provide advice and assistance as

necessary.

We will resize a bespoke ring if it is not right first time.

Cancellations

If you make a mistake when ordering please contact us as soon as possible. We are unable

to accept cancellations on bespoke, customised or personalised orders already in

production. Deposits paid for bespoke, customised or personalised items are non-

refundable.

Social Media & Marketing

From time to time, Midastouch Jewels may post ‘progress’ and ‘finished’ photographs of

bespoke jewellery on our social media feeds. If you place an order of a bespoke piece and

would prefer us not to do this at the time of making, then please do let us know. If your

order is a special gift and you would like us to hold off of posting images on social media

until you have given the gift, please make us aware of this at the time of payment, so we can

include this in your project details. Please also provide us with the date of when we are able

to post photographs of the finished item(s).

All finished bespoke jewellery will be photographed and images will be posted on our social

media pages and on helennoakesjewellery.com unless expressed otherwise by the

customer.

Bespoke jewellery

Consultations for bespoke pieces are free. During the consultation, details and notes of your

requested design and specifications will be made. Once you are happy with your final design

specification for your project, have confirmed via email that all details are correct, and that

you are ready to go ahead, we can proceed with your order. Payment in full s required

before commencement of all bespoke projects. Please note any quotes received are valid

for 30 days from date of issue due to the fluctuations in metal prices. We do reserve the

right to change a quote within this time frame if there is a change in metal prices, but this is

a rare occurrence.

Once a design has been agreed on, the client has to honour this agreement. Midastouch

Jewels cannot be held accountable for any changes to personal views on reflection after

work on the piece has commenced. Please note we will match the design as closely as

possible when translated into your precious metal jewellery, but please bear in mind that

any design is just an indication of how the finished jewellery will look- and because the

jewellery is handmade, some slight variations from the sketch and the final finished

jewellery may occur.

Once an order for bespoke jewellery has been placed and paid for, we take this as

acceptance of our terms and conditions on bespoke jewellery. No major changes can be

made once you have confirmed the design and once you have paid, and your order cannot

be cancelled or refunded. Any changes made to an order after acceptance of specifications

and payment may incur a charge. No refunds will be given on any bespoke piece of jewellery

at any time.

A photo of completed work can be provided for approval, if there is a delay between

completion and pick up.

Alterations may be made after a bespoke piece has been received will incur an additional

charge. Midastouch Jewels will be happy to help but this will not be included in your original

price.

If you’d like to discuss the practicality and wearability of your bespoke jewellery idea before

proceeding, we’re more than happy to help. Please note, jewellery may tarnish over time.

By agreeing to go ahead with any bespoke piece, you accept these terms and conditions

Refunds, Returns, Exchanges and Breakages for Buyers

If you’re a seller outside of the EU, you must set a return policy whenever you edit or

create a new listing for a physical item, even if it is to let buyers know you do not

Breakages

Customer Breakages

You can return a piece of jewellery because it is damaged. Under the Consumer

Rights Act 2015, you may be entitled to a refund if goods purchased are:

 Broken or damaged

 Unusable

 Not as described.

 

Supplier Breakages

Whilst all our jewellery is handmade, we may use other organisations to provide

special items such as gemstones, chains and clasps. All items are inspected as soon

as possible after arrival In our studio. We aim to increase the chance of catching

faulty goods before they reach customers.
